Se han cumplido cincuenta años desde la publicación de Teoría de la Justicia. Sin duda, la obra de J. Rawls marcó un hito fundamental en la historia del pensamiento político del siglo XX. Nuestro trabajo se pregunta hasta qué punto la justicia como imparcialidad sigue siendo una referencia fundamental en el pensamiento político actual. Para ello abordamos la propuesta de M.C. Nussbaum. Nos planteamos si el enfoque de las capacidades de Nussbaum es realmente una continuación o supone una (...) verdadera ruptura con la propuesta de Rawls. Y a partir de las objeciones de Nussbaum a Rawls, nos interrogamos por el presente y el futuro de una obra que, a nuestro juicio, después de medio siglo, parece tener todos los ingredientes necesarios para ser verdaderamente un clásico del pensamiento político. ¿Cómo pueden las emociones favorecer una sociedad democrática más justa y estable? El propósito de este artículo es destacar la importancia de las emociones en el pensamiento de M. C. Nussbaum, y cómo pueden contribuir, en el contexto del liberalismo político, a reforzar y dar estabilidad a la democracia. Todo ello parece exigir, según Nussbaum, integrar el papel de las emociones en el proyecto educativo de la sociedad, para superar el modelo de justicia centrado en el beneficio mutuo, ampliándolo (...) con otro, cuyo centro de gravedad serían las capacidades y el desarrollo humano. Y en tal sentido, es necesario preguntarse por el papel que han de jugar las humanidades, para dar viabilidad y continuidad a tal proyecto.How can emotions enable a fairer and more stable democratic society? The aim of this essay is to emphasize the importance of emotions in M.C. Nussbaum’s thought and how can they contribute to reinforce democracy and provide it with stability to in the context of political liberalism. All of this seems to require, according to Nussbaum, the integration of the role of emotions in society’s educational project, so as to go beyond the model of justice focused on the mutual benefit, widening it with another, whose centre of gravity would be the capacities and the human development. El cosmopolitismo es uno de los elementos fundamentales de la concepción de la justicia defendida por M.C. Nussbaum. Esta sería una de las tesis esenciales del presente ensayo. El enfoque de las capacidades (EC) defendido por ella pretende ser una alternativa a las modernas teorías del contrato. Para Nussbaum, dignidad, capacidades humanas y recursos materiales son indesligables. Del mismo modo, la perspectiva cosmopolita es una exigencia inexcusable en la teoría de la justicia de Nussbaum. Pero esa relevancia se malograría si fuera interpretada en un sentido contrario a su genuina intención. Ella no está, en efecto, en abrir la puerta a un irracionalismo romántico ni en proponer un retorno a una fundamentación premoderna, metafísica o teológica, de la moral, anticipándose a buena parte del actual pensamiento neoconservador. A partir del comentario hecho por José L. L. Aranguren sobre «puede» y «debe» en ética, aquí se plantea el significado de los principios de ética en la situación de retroceso democrático del siglo XXI. Ha sido analizada por la filosofía y la teoría política recientes. En los años sesenta, las críticas de D. Sternberger al modelo de polis, de política cívica en las obras de H. Arendt, se apoyaban en la imagen de la ciudad hundida. Pero las preguntas (...) sobre el alcance del realismo («puede») y el lugar de los principios («debe») siguen abiertas. ¿Ultra posse nemo obligatur? Aquella imagen de la polis puede ser reemplazada por otra algo distinta, la ciudad sumergida. Se encuentra en la literatura, sería también la metáfora de la necesaria reconstrucción de las políticas democráticas, con el «deber ser» como núcleo de la cultura cívica. Los principios éticos y, en especial, justicia como equidad será aquí la referencia en dos situaciones: (1) la política de salud pública, (2) los procesos de paz. En conclusión, el marco normativo cuenta o ha de contar, tanto en la paz como en la guerra. Decir «nunca más» es también una forma de recordar el papel crucial de los principios. (shrink)

This paper studies an Umayyad Andalusi foundation inscription, dated 387/4 January 997-2 January 998, which is no longer extant but has been transmited in a summary in Castilian on a tablet dated 1259 and repaired in 1575. An attempt is made to deduce the original Arabic text, and the documented facts and persons are discussed.

Disregard of gender and of women’s contributions in the higher education curriculum is still a widespread phenomenon. Building on feminist institutionalism, this article explores the forms and types of resistance that efforts to engender the higher education curriculum must contend with and discusses the ways in which resistance to curricular reform is entrenched in a web of both gender-specific and apparently gender-neutral academic informal rules. In doing so, the authors use empirical evidence collected by an action-research project undertaken at a (...) faculty of political and social sciences in a Catalan public university. The Spanish case is intriguing because mainstreaming gender in higher education has been prescribed by various national and regional laws that are nonetheless poorly implemented. The article also reflects on the positive feedback loop action-research projects can facilitate within gendered institutions such as universities and pinpoints the role of feminist agency in counteracting resistance to institutional change. La crítica situación económica actual, ha potenciado que las empresas asuman sus responsabilidades y se instaure la cultura de la Responsabilidad Social. Partiendo de la base de que las empresas, en el desarrollo de su actividad cotidiana, cumplen con las leyes que les afectan, si desarrollan un sistema de gestión de la Responsabilidad Social (RS) adaptado a las (...) características de cada empresa, podrían obtener beneficios adicionales. La Norma Internacional ISO 26000 indica como implantar la RS en las empresas y la RS 10 fija los requisitos de acuerdo con la ISO 26000. En este trabajo se lleva a cabo una comparación crítica. Este artículo expone el resultado de la puesta en práctica de una metodología docente novedosa a través de la que se busca superar las dificultades que el proceso de enseñanza/aprendizaje encuentra en las asignaturas jurídicas que forman parte de los grados universitarios no jurídicos. Comienza destacando el papel que tienen las tecnologías de la información y la comunicación en dicho proceso y, significativamente, el campus virtual. Nuestra investigación etnográfica (2019- 2020) en torno a las exhumaciones de fosas comunes del franquismo en el cementerio de Paterna (Valencia) planteó una serie de cuestiones sobre la importancia de realizar una aproximación biográfica a los escenarios de violencia y perpetración. Esto nos proporciona una potente herramienta de análisis que permite ir más allá de la mera secuencia temporal de los hechos y los espacios, dotándolos de agencia propia. IntroductionThe present study aims at analysing how social support received and provided by parents of children, adolescents and young adults (AYA) diagnosed with cancer, as well as their sociodemographic and clinical variables, affect those parents’ stress levels and life and family satisfaction.Materials and MethodsA total of 112 parents of children and AYAs who had been diagnosed with cancer and who received treatment in Malaga participated in the study. In the study, participated all parents who voluntarily agreed to fulfil the questionnaire. (...) The main inclusion criterion was that their child had cancer. Instruments used were Questionnaire on the Frequency of and Satisfaction with Social Support (QFSSS), Paediatric Inventory for Parents (PIP), Life Satisfaction Scale and Family Satisfaction Scale.ResultsIn the mean difference analyses, male parents showed 3.38 (SD = 0.56) in social support received and female parents showedM = 3.08 (SD = 0.72). Conversely, in social support provided, female parents showed 3.22 and male parents showedM = 3.55 (p = 0.020). Significant differences were also found in family satisfaction, where female parents (M = 3.64) feel more satisfied than male parents (M = 3.06;p = 0.027). Parents of children aged between 0 and 14 years (M = 3.06) feel more stress than those parents of children aged 15–21 (M = 2.61;p = 0.021). The correlation analysis shows that there is a negative and significant relation between stress levels experienced by parents when facing different situations related to the child’s disease and both types of support, receivedr = −0.411,p < 0.001 and providedr = −0.282,p < 0.01. There is also a positive and significant relation between life satisfaction and social support receivedr = 0.292,p < 0.01, and social support providedr = 0.409,p < 0.001. There is a positive and significant relation between family satisfaction and social support receivedr = 0.330,p < 0.01, in the same way as with social support providedr = 0.222,p < 0.05. The regression analysis related to stress levels of parents indicates that social support received predicts levels of stress significantlyp < 0.001, with the variable of number of children being the one that showed to be significantp < 0.05. Social support provided showed the most significant resultsp = 0.001, meaning that social support provided increased life satisfaction. Social support received explains family satisfaction (p = 0.50), as it increases the family satisfaction of parents of children with cancer.DiscussionAnalysing social support received and provided, as well as sociodemographic and clinical variables, allowed us to broaden the knowledge on the effect social support has on stress levels, life satisfaction and family satisfaction in parents of children and AYAs diagnosed with cancer. This may have relevant practical implications for the design of interventions that would improve parents’ lives. (shrink)

Background:The acquisition of experience is a major concern for nurses in intensive care units. Although the emotional component of the clinical practice of these nurses has been widely studied, greater examination is required to determine how this component influences their learning and practical experience.Objective:To discover the relationships between emotion, memory and learning and the impacts on nursing clinical practice.Research design:This is a qualitative phenomenological study. The data were collected from open, in-depth interviews. A total of 22 intensive care unit nurses (...) participated in this research between January 2012 and December 2014.Ethical considerations:The School of Nursing Ethics Committee approved the study, which complied with ethical principles and required informed consent.Findings:We found a clear relationship between emotion, memory and the acquisition of experience. This relationship grouped three dimensions: (1) satisfaction, to relieve the patient’s pain or discomfort, give confidence and a sense of security to the patient, enable the presence of family members into the intensive care unit and provide family members with a realistic view of the patient’s situation; (2) error experience, which nurses feel when a patient dies, when they fail to accompany a patient in his or her decision to abandon the struggle to live or when they fail to lend support to the patient’s family; and (3) the feel bad–feel good paradox, which occurs when a mistake in the patient’s care or handling of his or her family is repaired.Conclusion:Emotion is a capacity that impacts on nurses’ experience and influences improvements in clinical practice. Recalling stories of satisfaction helps to reinforce good practice, while recalling stories of errors helps to identify difficulties in the profession and recognise new forms of action. The articulation of emotional competencies may support the development of nursing ethics in the intensive care unit to protect and defend their patients and improve their relationships with families in order to maximise the potential for patient care. Corporate America is institutionalizing ethics through a variety of structures, systems, and processes. This study sought to identify managerial perceptions regarding the institutionalization of ethics in organizations. Eighty-six corporate level marketing and human resource managers of American multi-national corporations responded to a mail survey regarding the various implicit and explicit ways by which corporations institutionalize ethics. The results revealed that managers found ethics to be good for the bottom line of the organizations, they did not perceive the need for additional (...) formalization of ethics, and that they perceived implicit forms of institutionalizing ethics (e.g., leadership, corporate culture, top management support) to be more effective than the explicit forms of institutionalizing ethics (e.g., ethics ombudspeople, ethics committees, ethics newsletters). The current training model being used in higher education advocates the acquisition of competences aimed at providing students with all-round training that will enable them to tackle their future work responsibilities effectively. This encompasses a number of different competences, most notably the transversal kind, especially in view of the important role they play in shaping the profile of any professional individual. The active learning methods applied to group work have shown to be the most suitable for achieving these competences. From (...) this perspective, and considering their relevance, we present the results of a study that addresses the perceptions held by students from Education Degrees regarding the extent to which transversal competences are acquired by implementing active learning methods. The students perceive group work as a dynamic that teaches them how to be more self-critical and committed to group-oriented tasks, thus encouraging communication skills, personal relationships and motivation. However, a lesser degree of acquisition has been recorded in other equally important competences. As such, it is necessary to promote these learning methods from the start, carefully designing and planning the curriculum structure as well as the tasks to be performed in order to avoid any negative implications that may arise. Scholars have long debated whether leader's integrity affects managerial decision making with respect to social responsibility. In this paper, we propose a model in which transformational leadership mediates integrity and corporate social responsibility and examine the relationship between these concepts. A survey of 170 senior managers from 50 organizations was conducted. Results indicate that integrity is a predictor of transformational leadership behavior and that transformational leaders’ behaviors are linked to CSR practices. It was also found that leaders rated with higher (...) integrity are engaged in CSR because they exhibit more transformational leadership behaviors. These findings add to the extant literature by demonstrating that integrity is important as transformational leaders engage more actively on ‘responsible’ behaviors. Practical implications call for an understanding among corporate leaders of the benefits of integrity and how it relates to transformational leadership. Organizations can improve their selection and leadership development processes by focusing on these two dimensions. (shrink)

Tarski's 1936 paper, “On the concept of logical consequence”, is a rather philosophical, non-technical paper that leaves room for conflicting interpretations. My purpose is to review some important issues that explicitly or implicitly constitute its themes. My discussion contains four sections: terminological and conceptual preliminaries, Tarski's definition of the concept of logical consequence, Tarski's discussion of omega-incomplete theories, and concluding remarks concerning the kind of conception that Tarski's definition was intended to explicate. The third section involves subsidiary issues, such as (...) Tarski's discussion concerning the distinction between material and formal consequence and the important question ofthe criterion for distinguishing between logical and non-logical terms.§1. Preliminaries. In this paper an argument is a two-part system composed of a set of propositions P and a single proposition c. The expression ‘c is a [logical] consequence of P’ is used with the same meaning as the expression ‘c is [logically] implied by P’. The expressions ‘is a logical consequence of’ and the converse ‘implies’ are relational. Often, I shall be talking in the same sense of validity of an argument. Validity is a property of arguments; an argument with premise-set P and conclusion c is valid if and only if P implies c; i.e., c is a logical consequence of P. Notice that this notion of argument is strictly ontic; it does not involve any agent that thinks, determines or establishes that a given proposition is or is not a consequence of a given set of propositions. Each science has its own domain of investigation, but one and the same science can be formalized in different languages with different universes of discourse. The concept of the domain of a science and the concept of the universe of discourse of a formalization of a science are distinct, although they often coincide in extension. In order to analyse the presuppositions and implications of choices of domain and universe, this article discusses the treatment of omega arguments in three very different (...) formalizations of arithmetic. In Peano's formalization the domain is a restricted class of individuals, while the universe of discourse is the unrestricted class of all individuals. In Gödel's formalization the domain is a restricted class of individuals as in Peano's formalization, but the universe of discourse coincides with the domain. In Whitehead-Russell's formalization the domain is a class of logical notions in Tarski's sense, that are necessarily not individuals, whereas the universe of discourse is the unrestricted class of individuals as in Peano's formalization. The present approach emphasizes the viewpoint that the universe of discourse of a given discourse is important in determining which propositions are expressed by which sentences. (shrink)

The aim of this paper is to introduce an alternative to Łukasiewicz’s 4-valued modal logic Ł. As it is known, Ł is afflicted by “Łukasiewicz type paradoxes”. The logic we define, PŁ4, is a strong paraconsistent and paracomplete 4-valued modal logic free from this type of paradoxes. PŁ4 is determined by the degree of truth-preserving consequence relation defined on the ordered set of values of a modification of the matrix MŁ characteristic for the logic Ł. On the other hand, PŁ4 (...) is a rich logic in which a number of connectives can be defined. It also has a simple bivalent semantics of the Belnap–Dunn type. (shrink)

The purpose of the paper and of their advocacy for the concept of relational validity is to improve the way that quantitative research is done by expanding our understanding of its ethics-laden aspects. I agree entirely with the authors that every decision regarding QR is an ethics-laden one and that our research as a whole would be improved (...) by recognition of this fact. Suppose that we are interested in the average causal effect of a binary treatment on an outcome when this relationship is confounded by a binary confounder. Suppose that the confounder is unobserved but a nondifferential proxy of it is observed. We show that, under certain monotonicity assumption that is empirically verifiable, adjusting for the proxy produces a measure of the effect that is between the unadjusted and the true measures.

The logic TM is the result of adding the mingle axiom, M to Ticket Entailment logic, T. In the present study, it is proved that TM has the variable-sharing property . Ternary relational semantics for TM is provided. Finally, an interesting extension of TM with the vsp is briefly discussed.

In this article, we propose a philosophical exploration on the main problems involved in two neurorights that concern autonomous action, namely free will and cognitive liberty, and sketch a possible solution to these problems by resourcing to a holistic interpretation of human actions. First, we expose the main conceptual and practical issues arising from the neuroright to “free will,” which are far from minor: the term itself is denied by some trends participating in the neurorights debate, the related concept of (...) ultimate control is also disputed, the understanding of free will depends on cultural context, and the exercise of being free to act in several domains may be covered by other regulations. Second, we analyze the historical origin of cognitive liberty, its current status, and its relation with free will. Third, we criticize the concept of decision in mainstream action theory and propose to conceive action as a unified process constituted by three explanatory, non-sequential dimensions: intention, decision, and action realization. Fourth, we discuss two possible cases involving neurotechnologies and suggest ways to interpret them according to a unified framework in which free will and cognitive liberty fall under a single neuroright to personal autonomy. Finally, we outline a recommendation to introduce freedom of thought and personal autonomy as complementary neurorights to protect both the internal and external dimensions of thought and action. Emotional intelligence (EI) stands at the nexus between intelligence and emotion disciplines, and we outline how EI research might be better integrated within both theoretical frameworks. From the former discipline, empirical research focused upon whether EI is an intelligence and what type of intelligence it constitutes. It is clear that ability-based tests of EI form a group factor of cognitive abilities that may be integrated into the Cattell–Horn–Carroll framework; less clear is the lower order factor structure of EI. From the (...) latter discipline, research linking EI with theoretical frameworks from emotion research remain relatively sparse. Emotion regulation and appraisal theory may be key to explain how EI may reflect different processes. We propose a research agenda to advance the EI study. (shrink)

Despite its obvious advantages, the disruptive development of neurotechnology can pose risks to fundamental freedoms. In the context of such concerns, proposals have emerged in recent years either to design human rights de novo or to update the existing ones. These new rights in the age of neurotechnology are now widely referred to as “neurorights.” In parallel, there is a considerable amount of ongoing academic work related to updating the right to freedom of thought in order to include the protection (...) of “freedom of thinking” (i.e., freedom of thought itself) and not only its social manifestations. Neurorights such as cognitive liberty, free will, mental freedom, and mental self-determination come into play here. Importantly, freedom of thought has often been considered a prerequisite for all the other fundamental freedoms and rights. In any case, just as other rights require additional legal instruments to guarantee their compliance, substantial neurorights will probably require specific complementary developments in procedural law. In relation to this, there is a long tradition of habeas corpus as an emergency remedy to enforce the rights of a citizen against illegal or arbitrary detention. More recently, the habeas data writ has been proposed and admitted in certain countries to guarantee a person’s ownership of their personal data. In this article, we propose to expand this procedural apparatus by incorporating a third habeas, which we call habeas cogitationem: a writ aimed primarily at enforcing the right to freedom of thinking (and, subsidiarily, the rest of neurorights) against direct, harmful interferences in a person’s thought process by both public and private perpetrators. Going from cognitive theory to neural data to ACT‐R models, the authors relate brain activity in a lexical ambiguity priming task to brain processes that resolve ambiguity in word meanings. These detailed data were tested and found compatible to the results of an ACT‐R computational model of reinforcement learning (RL). The model confirms and extends the behavioral findings to provide a RL account of individual differences in lexical ambiguity resolution.

In line with this approach, they argue that (1) MDs should be considered not from within psychology and psychiatry, but rather from the realm of philosophy, so as to (...) avoid what they call the Charcot effect; (2) the resulting theoretical model is in contrast to naturalist models such as that of internal dysfunction, and involves “strong” constructivist assumptions from which they develop an anthropological perspective based on the clinician–patient situation; 3) this model is applicable, in principle, to all MDs (“at least to some extent”); and (4) it is based on the Aristotelian theory of the four causes.We would argue, however, that (1) it is precisely from within psychology and psychiatry that conceptual models accounting for MDs should be proposed; (2) the naturalist–constructivist dichotomy in these models should be deconstructed, and primacy given not to the ontological approach but to the epistemological one; (3) a theoretical model of this scope should account not only for MDs but also for physical disorders; and (4) only in this way would the Aristotelian theory of causes, understood as types of explanation (and therefore as epistemological approaches) be useful.Approaches from within and from WithoutFor Berrios (2006), the theoretical discourse in relation to the conceptualization of MDs in a particular sociocultural context can be formulated in two ways: on the one hand, in a centripetal fashion, using established philosophical systems (be it phenomenology [Jaspers 1977], logical empiricism [Hempel 1994], or analytic philosophy [Fulford, Thornton, and Graham 2006]). This centripetal approach can be used both by professional philosophers and by psychiatrists/psychologists. When developed by professional philosophers, such proposals, despite their possible brilliance, run the risk of being tangential to the psychiatric issues owing to a lack of first-hand experience of them (Murphy 2006). When developed by psychiatrists and psychologists, the majority of the proposals simply mix fragments of different philosophical systems, in either a kind of syncretism or collage that fails to take into account the contradictions between fragments, or a kind of pluralism that reflects, without entering into analysis, a sort of consensus among the different paradigms (Ghaemi 2003; Kendler 2005).A second way of formulating this theoretical discourse (according to Berrios) would employ a centrifugal approach from the very core of the disciplines, through the reflection of professionals (primarily, although not only, psychiatrists/psychologists with philosophical training) who would conceptualize the problems from within and develop a specific metalanguage for analyzing [End Page 265] them (Lanteri-Laura 1991; Reznek 1991; Sass 1992). Not all problems are of the same type. For those that are extrinsic to psychiatry/psychology (definition of the mental, the mind–body relationship, the distinction between causes and reasons, or interdisciplinary reduction), the methods common to the philosophy of science and of the mind can be used. However, issues intrinsic to the disciplines themselves (the nature of mental symptoms and how they are generated, how to explain their heterogeneity, what a MD is, how to diagnose and classify it, or how to implement a psychopathological project) cannot be dealt with using preestablished formulas, and require new and original proposals that take into account the nature of the disciplines and their object of study (Villagrán 2007).The authors of the target article base their preference for the centripetal approach for responding to one of the intrinsic questions of psychiatry (what MDs are) on the consequences of what they call the Charcot effect, a kind of variant of observer bias applied to psychiatric diagnosis. They offer as an example the classic diagnosis ad iuvantibus in its postmodern version, namely, the efficacy of the pharmaceutical industry in contributing to creating nosological entities for which their drugs are indicated. This article discusses two coextensive concepts of logical consequence that are implicit in the two fundamental logical practices of establishing validity and invalidity for premise-conclusion arguments. The premises and conclusion of an argument have information content (they ?say? something), and they have subject matter (they are ?about? something). The asymmetry between establishing validity and establishing invalidity has long been noted: validity is established through an information-processing procedure exhibiting a step-by-step deduction of the conclusion from the premise-set. Invalidity is established by (...) exhibiting a countermodel satisfying the premises but not the conclusion. The process of establishing validity focuses on information content; the process of establishing invalidity focuses on subject matter. Corcoran's information-theoretic concept of logical consequence corresponds to the former. Tarski's model-theoretic concept of logical consequence formulated in his famous 1936 no-countermodels definition corresponds to the latter. Both are found to be indispensable for understanding the rationale of the deductive method and each complements the other. This study discusses the ontic question of the nature of logical consequence and the epistemic question of the human capabilities presupposed by practical applications of these two concepts as they make validity and invalidity accessible to human knowledge.
